Brazil's INSS pension fraud: verified facts and figures
R$6.3 billion diverted, 97.6% of deductions unauthorised and over R$3 billion refunded: the verified numbers of Brazil's INSS pension fraud scandal.
In April 2025, Brazil's Federal Police and the Comptroller General's Office (CGU) uncovered a large-scale scheme in which associations deducted monthly fees from INSS pensions without retirees' consent. Investigators estimate that associations appropriated R$6.3 billion between 2019 and 2024.
How the scheme worked
Technical cooperation agreements allowed associations to deduct fees directly from benefits. Many entities existed only on paper, charged for services they never provided, and kept amounts small so victims would not notice. A CGU audit of 29 entities found that 97.6% of 1,300 beneficiaries interviewed had not authorised the deduction, according to IstoÉ Dinheiro.
Operation and fallout
Operation "Sem Desconto" involved about 700 federal agents and 80 CGU staff, 211 search warrants and asset-freeze orders above R$1 billion. The INSS president was removed and all cooperation agreements were suspended (O POVO).
Investigators are also examining whether retirees' personal data were obtained from INSS staff through bribes and then registered with the associations without beneficiaries' knowledge. Between January 2023 and May 2024, the INSS had already received one million complaints about improper deductions, a warning sign that went largely unaddressed. The audit also found that the entities lacked any operational structure to deliver the promised services and that 70% failed to provide required documents.
Refunds
Under an administrative settlement subject to Supreme Court approval, entities have 15 business days to refund or prove consent; otherwise the federal government repays the amount adjusted for inflation (INSS). By 26 December 2025, R$2.82 billion had been refunded across 4.1 million requests (Agência Brasil). By April 2026 refunds exceeded R$3 billion, with about 6.4 million beneficiaries confirming improper deductions out of 9.5 million affected (Viva).
Congressional inquiry
The joint congressional inquiry (CPMI) closed on 28 March 2026 without an approved report: the rapporteur's 4,340-page text, seeking 216 indictments, was rejected 19 to 12 (Movimento Econômico). Police and prosecutors continue their own investigations.
Lessons
The fraud exploited a legal mechanism (payroll deductions), weak oversight of agreements with third parties, and the difficulty many elderly people have in checking statements. It also shows how misuse of personal data can feed financial fraud at scale, an issue that touches Brazil's data protection law (LGPD). Most refunds were requested through the Meu INSS app (53.8%) and post offices (36%), showing the importance of in-person channels for older citizens.
What to do
- Check deductions in the Meu INSS app ("Consultar Descontos de Entidades Associativas").
- Dispute unauthorised charges through the app, the 135 hotline or a post office, and confirm with INSS whether the window is still open.
- Avoid intermediaries charging fees: the official process is free.
- Help elderly relatives use the app and review their deductions regularly.
